| Seeking copies of degree certificates of employees | | IUST denies info, SIC dismisses said order | | Early Times Report
Srinagar, May 18: The Islamic University of Sciences and Technology (IUST) Awantipora has denied information to some information seekers who sought copies of foreign degree certificates obtained by some non teaching staff members of the university. The IUST authorities had invoked section 8 (1) (i) and claimed that information sought under RTI Act pertains to 3rd party information. As the case landed in State Information Commission (SIC), the SIC rejected the claim of IUST authorities and directed them to provide all the information within a time of 15 days.
Details available with Early Times revealed that an RTI application was filed by Wali Mohammad Dar & others under J&K RTI Act, 2009 on 01.12.2014 before Public Information Officer (PIO) Islamic University of Sciences and Technology (IUST) seeking details of information related to degrees obtained by some non-teaching employees. This RTI application was partially disposed by PIO of IUST Sheikh Asif on 23.01.2015 stating that information sought is ready except for some points as the same falls under 'third party' information section 8 (1) (i). He has accordingly requested the information seekers to deposit an amount of Rs. 5000/- @ Rs. 10/- per page in the University account and collect the requisite information. As regards to providing copies of degree certificates of some non teaching employees information seekers were advised to attend the office of First Appellate Authority (FAA) ie Registrar IUST Awantipora. The crux of the appeal is that appellants have sought details of employees with foreign degrees selected for a particular post and employees who have acquired higher qualification during service respectively. PIO clarified during proceedings that he has not denied information, but only stated that this is a 3rd party information and asked the information seeker to attend the office of FAA in connection with this information. FAA, in his counter reply filed before SIC has also not denied disclosure of information but stated that this was brought to his notice only through clarification of the appellant addressed to SIC. According to SIC order, "In view of above PIO/FAA shall provide information to applicants sought at Point numbers 4 & 5 in whatever form available on record. Besides, incomplete information in respect of other points be provided to the appellants as available on record within two weeks from issue of this order. It is further to clarify that as per definition of 'right to information' public authority are required to provide information as per records only and they are not required to collate or create information as per a set format given by the appellants". |
