DB directs Police to constitute specialized teams

JAMMU, Feb 13: A Division Bench of Jammu and Kashmir High court comprising of Justice Badar Durez Ahmed(Chief Justice) and Justice Dhiraj Singh Thakur while hearing the PIL seeking check on sale of Narcotic Drugs and Psychotropic Substances, directed the Police Department to consider constituting Specialized Teams and file the response before the next date of hearing.
Counsel for the respondents submitted that pursuant to the directions given by the Court, certain Standard Operating Procedures have been put in place with regard to the recovery and investigation in the cases of Narcotic Drugs and Psychotropic Substances. The Standard Operating Procedures were put in place on 25.09.2017. Two Monitoring Cells have also been established at the Provincial level for Jammu and Kashmir by an order dated 06.02.2018.
Sunil Sethi, Sr Advocate, appearing as an Amicus Curiae, submitted that it is general knowledge that the drugs are being supplied to the School students and College students and are available in particular areas within Jammu City.
DB after hearing the contentions directed the learned counsel for the respondents to file a status report, indicating whether the Standard Operating Procedures have been implemented in letter and spirit and what are the tangible results of the new Standard Operating Procedures.
DB directed the Home department to ensure that the locations that are provided by Adv Sethi, are monitored and shall submit a report with regard to the action taken.
DB held that it would be appropriate, if the SSP Jammu carries out this exercise and locations where the drugs are allegedly freely sold have also been mentioned in WPPIL No. 30/2017 in paragraph 6 thereof. The same may also be got investigated by the SSP Jammu. DB opined that the court would also like to have information as to whether, in cases where the recoveries are made of Narcotic Drugs and Psychotropic Substances, the Investigating Team also investigates the source of supply of these Narcotic Drugs and Psychotropic Substances.
