HC 'satisfied' with wildlife department's regarding Hirpora Wildlife Sanctuary

SRINAGAR, Dec 12: The High Court has expressed satisfaction with the State Wildlife department having taken all the factors into consideration for restoring the damages caused to the Hirpora Wildlife Sanctuary situated in Shopian in South Kashmir.
"We are further satisfied that the Wildlife Department has duly been compensated to fully restore the damages by the executing agency," said a division bench of Justices Ali Mohammad Magrey and Sanjeev Kumar.
The court directed the state to ensure implementation of the provisions of law while undertaking the restoration work with reference to the preservation of the sanctuary and also ensure that the restoration work was completed.
"The report in this behalf shall be submitted before the Registrar Judicial of this Court within a period of six months from today," the court said, adding, "Needless to mention that the project work was undertaken by the executing agency pursuant to the permission granted by the Government in terms of Government Order No. 248-FST of 2016 dated 4-10-2016, and the damage caused, as submitted by the teamed counsel for the executing agency, is neither intentional nor deliberate." The court accordingly closed the PIL.
The sanctuary is home to Himalayan Brown Bear, Himalayan Black Bear, Musk Deer, Leopard, Tibetan Wolf, Himalayan Palm Civet and around 50 individuals of the critically endangered Pir Panjal Markhor, besides 130 bird species.
The petition had alleged that a company entrusted with the laying of Transmission Line through Hir­pora Wildlife sanctuary has violated the norms. The company was supposed to lay the power line and erect towers in the sanctuary on the condition that the work should be done manually so as to avoid damage to the flora and fauna of the area but it has used heavy ma­chinery for the purpose.
The PIL had sought immediate steps for the conservation and preservation of Hirpora Sanctuary from illegal and unlawful blasting and heavy machinery.
