PIL on Solid Waste Management; CS given presentation by EPG

Jammu, Dec 12: On the orders of J&K High Court , Chief Secretary (CS) was given a power point presentation by Environmental Policy Group (EPG) at Civil Secretariat Jammu on Wednesday. Recently Government through Housing & Urban Development Department (HUDD) had sought suggestions/views of the stakeholders on State Policy on Solid Waste Management Strategy, 2017 and Draft Action Plan for Municipal Solid Waste Management J&K. During presentation state policy on solid waste management was also discussed.
Government had issued a notification on Oct 4th wherein the Draft Action Plan for Municipal Solid Waste Management J&K-2018 was prepared in pursuance to Solid Waste Management rules, (SWM 2016 ) Rule 5. Govt through a press release had said "The draft Action Plan is available on the department's website http:/ /jkhudd.gov.in/ for providing suggestions/ comments,"
As reported already public at large and the concerned stakeholders were requested to visit the department's website and furnish suggestions/comments within 30 days from the date of issuance of notice so that the Action Plan could be finalized. During the meeting members of EPG lead by Syed Nasarullah apprised Chief Secretary that people are not able to find any address or email ID after opening the draft action from HUDD website , "where shall people send my comments" ?
During the meeting Chief Secretary assured EPG members that Govt will ensure to institutionalize the waste management work in J&K.
Pertinently J&K High Court on Oct 3oth had directed state government to submit status report on draft action plan for Solid Waste Management (SWM) bylaws. In addition to it High Court Chief Justice had asked Chief Secretary to allow members of EPG to give a presentation on solid waste management. In another hearing division bench of Justice Ali Mohammad Magrey and Justice Sanjeev Kumar came after the counsel of petitioner organization Shafqat Nazir had told the court that public feedback sought by the state on draft byelaws was published in low circulated newspapers with no official address of the feedback receiving officer or his email id .
Senior Additional Advocate General (AAG), B A Dar had informed court that a meeting as directed by the court vide its order dated 17.9.18 had been convened under the chairmanship of Chief Secretary of the state and the draft Action Plan about SWM bylaws has been forwarded to Secretary Tourism for seeking suggestions from general public.
Dar added that for seeking suggestions to SWM bylaws, information was published in various newspapers to which petitioner counsel stated that information was published in low circulated newspapers.
On hearing this, the court directed for status of whole process to be submitted on next hearing. During the previous hearing High court had asked state government to examine the Solid Waste Management bylaws (SWM bylaws) of other states of the country and had asked if the SWM bylaws require to be notified by the government in accordance with the provisions of the Environment Protection law.
High Court division bench also directed Srinagar Municipal Corporation (SMC) to file an affidavit vis a vis management of Solid Waste Management in the Srinagar city.
