SHRC directs Govt to provide ex-gratia relief to kin
Death of SPO in Rajouri fake encounter

Jammu, Sept 25: In a significant order the State Human Rights Commission headed by Habibullha Bhat, acting chairperson, in its decision in a complaint has directed the State government through Chief Secretary to extend ex gratia relief and other benefits to the complainant whose son working as SPO and attached with 18 Dogra in 1997 was allegedly killed in fake encounter by the officers of the unit before leaving Rajouri for their placement in peace area. State Human Rights commission in its decision on file NoSHRC 281/2009 has directed the state government to extend the benefits under SRO 43 to one Ghulam Mohd s/oHaji Sher Mohd of village Richwa (Keri) in Rajouri district whose son was not traceable since 1997 when he was attached with 18 Dogra and the unit left Rajouri.
In his complaint with the SHRC Ghulam Mohd had said that his son Mohd Yusuf was forcibly taken to POK by some unidentified persons in the year1993 for arms training and after crossing back from Keri sector he surrendered before the officers of Dogra unit. He was later handed over to police and was booked inFIR No18/1996 and was released in the month of September as , according to the then senior police/army officers, Yusuf could produce fruitful results in providing informations about anti national elements (ANEs) .
As per the details with SHRC complaint, he started working as Special Police Officer (SPO) on Rs1500 honorarium and was also provided salary for the months May, June and Jult,1997 as per information provided to SHRC by the DDC Rajouri. In the year 1997 Yusuf was attached with 18 Dogra and after it 2 Sikh Light unit took the charge of the area from Dogra.
However, father of Yusuf have alleged that after 18 Dogra left Rajouri in 1997, his son did not turn up at home . Since then he approached every senior police/army officer to provided the information about his son but his every effort failed in seeking his whereabouts .
After a gap of about 12 years Ghulam Mohd also approached the SHRC and Vide his File No 281/2009 Rafiq Fida and A Singh ,members of SHRC started proceedings in the complaint and all the records were called from SSP and DDC offices from Rajouri.After going through the records and vide it decision on file NoSHRC 281/2009 on April18,2013 Members SHRC observed that for the last 7 years under section 107/108 J&K evidence Act police failed to produce the evidence that he (Mohd Yusuf s/o Ghulam Mohd of village Richwa)is alive.
SHRC observed that statements of witnesses/evidence are in line with complaint and upon further considering the reports, records and appreciation of evidences it directed the state government to extend ex-gratia relief and other benefits of SRo43 to the deceased family. When contacted FC Bhagat, DDC said that they have received the official copy of SHRC from the government recently. "The matter is under consideration and soon the file will be put before the DDC Rajouri for further action/decision" said Sachin Dev Singh Additional DC.
