Jammu, June 9 (JNF): In a petition filed by one M/S Hotel Novelty situated at Ragunath Bazar Jammu challenging the notification issued by Chairman J&K State Pollution Control Board, Jammu by virtue whereof commercial operation of Hotel Novelty, Raghnath Bazar Jammu has been suspended for not complying with the requirement of effluent/sewage standards by having STO of requisite capacity in the Hotel, Justice Bansi Lal Bhat of J&K High Court Jammu Wing after hearing Adv Pranav Kohli appearing for the petitioner issued notices to Commissioner-cum-Secretary Tourism Dept, Chairman J&K State Pollution Control Board, CEO ERA Jammu, Director Tourism and Regional Director PCB returnable within four weeks. Advocate Pranav Kohli appearing for the petitioner submitted that only ground contained in the impugned order is that the hotels having capacity of 20 or more rooms are required to meet the effluent / sewage standards prescribed under Environment Protection Act by having STP of required capacity in place in the Hotel. It is imperative to state here that the standards laid down in the impugned order do not pertain to the petitioner hotel as the petitioner hotel is having only 11 rooms. Petitioner Hotel Novely Raghunath Bazar, Jammu was setup in the year 1970 and was registered with the J&K Tourism Department somewhere in the year 1985. Petitioner hotel is situated on the ground, first and second floors comprising of 3 rooms on the ground floor, and 04 rooms each on the second and third floors respectively. Justice Bansi Lal Bhat after hearing Advocate Pranav Kohli in length ordered that in the meanwhile subject to objections from other side and till next date of hearing before the Bench, operation impugned order dated May 10, 2014 shall remain stayed.
