Three get lifer in murder case | | | Jammu, June 10 : Principal Sessions Judge Poonch Jaffer Hussain Beigh today awarded life-imprisonment to two real brothers namely Pervez Ahmed and Farooq Ahmed and Shamim Akhter W/O Farooq Ahmed for committing murder of Shamim Akhter W/O Pervez Ahmed Chouhan by means of poison. According to the police case a report lodged by Showkat Hussain at 09.10 hours on 22nd day of October 2011 at the aforesaid Police Station that her sister Shamim Akhter was married to the accused Pervez Ahmed more than 15 years ago and out of this wedlock a son was born who is of the age of 4 years and her sister was performing her duties as a faithful wife of the said accused but the accused was treating her with cruelty and use to beat her for the last two years in order to get himself married with any other woman. On that day of 22nd October 2011 at about 8.00 am the accused Pervez Ahmed, Farooq Ahmed, Shamim Akhter W/O Farooq Ahmed, Abdul Qayoom and Shamim Akhter W/O Abdul Qayoom after forming unlawful assembly with common intention of committing murder entered into the kitchen of her sister, caught hold, assault and caused injury to her. The accused Pervez Ahmed kicked on her belly and then threw her down from the kitchen as a result of which she died whereafter all the accused persons put some poisonous substance in her mouth and cried by saying that the deceased took poison. On this FIR No.204 of the year 2011 for commission of offence u/Ss 302, 147, 34 RPC stood registered in Police Station Surankote. After completion of the investigation offences u/Ss 302,328, 147 read with section 34 RPC were established against all these five accused persons and challan was presented. Principal Sessions Judge Poonch Mr. Jaffer Hussain Beigh after hearing Public Prosecutor Choudhary Nazir Hussain for the State whereas Advocate Taj Hussain Shah for the accused persons acquitted Abdul Qayoom and his wife Shamim Akhter whereas convicted Pervez Ahmed and Farooq Ahmed and Shamim Akhter W/O Farooq Ahmed for the offence u/s 302 RPC. The Court found that the case does not fall within the category of 'rarest of rare case' and accordingly sentence each of the accused, namely, Pervez Ahmed, Farooq Ahmed and Shamim Akhtar W/O Farooq Ahmed to undergo rigorous imprisonment for life and also to pay a fine of Rs.7000/- for the commission of offence under section 302 RPC.(JNF) |
