Terminated for rape, Dr Javid likely to be reinstated

JAMMU, June 10: Compromising all norms of propriety, the Health and Medical Education (HME) department is mulling to reinstate a doctor who was terminated following charges of rape on the frivolous excuse of shortage of specialized doctors for the patient care.
The terminated doctor is facing grave criminal charges of rape besides other offenses for which a challan had also been produced in the court of law by the police.
According to sources at HME department on June 5, Minister concerned in his noting had agreed to repeal the order number 500-HME of 2013 dated September 3, 2013, in which Dr Javid Iqbal was terminated and discharged from the service.
"The case is being reviewed in violation of norms, as the doctor was terminated nine months back, there was time frame to review his case", said an senior official at HME, adding that instead of admitting the facts, Government was raising figure on senior bureaucrats who had terminated the doctor as per law.
"Since there is an acute shortage of specialized doctors for the patient care, I agree, we should repeal the Government order", Minister for Medical Education, Taj Mohi-ud-Din agreed in his noting. They further said that the Minister would take up the issue in Cabinet meeting which is scheduled on June 11.
Earlier on September 3, 2009 the Health and Medical Education department had terminated the said doctor. "The official remained under suspension from August 24, 2011 to February 2, 2012 and from May 16, 2012 to September 29, 2012 totaling the period as 9 months and 23 days and has also remained in police custody for 42 days", HME department order of 2013 read.
The order further read that Dr Javid was involved in cases of criminal nature. "The official was involved in cases of criminal nature and has been absent from duty for long durations apart from being in police/ Judicial custody and, there, it is assessed that Dr Javid is not suitable to be retained in the Government service and his continuance in the services is not in the interest of the department", the earlier order read, adding that J&K civil services (Classification, Control and Appeal) rules, 1956 under rule 21 (1) (b) the Government at its discretion terminate and the probation period of probationer and discharge him from the service and in exercise of the power vested in the Government, the probation of Dr Javid Iqbal was terminated and he was discharged from the service with immediate effect.
It is pertinent to mention here that former MoS Health Shabir Ahmed Khan has been facing charge of molestation, recently a paramedic has leveled charges of molestation against Director Health Services, Kashmir and a doctor working at Sub District Hospital Nowshera was also booked for rape charges, but such approaches of Government to defend the persons who have committed heinous crimes like rape is discouraging the victims.
In Dr Javid Iqbal's case Rajouri police on May 12, 2014 had produced challan at CJM court Rajouri. Following a complaint lodged by Smaira alias Gurpreet Kour, a case was registered under sections 376/406, 420/379, 120-B RPC in 2012 at P/S Rajouri.
