Zahid Farooq killing case: Court dismisses revision petition | | | Early Times Report Srinagar, June 11: A local court here has rejected a revision petition filed by the family of Zahid Farooq, who was killed allegedly by BSF during 2010 summer unrest. The family through uncle of the slain boy had filed revision petition against an order by Chief Judicial Magistrate Srinagar passed in September last year. "I am of the opinion that it would be wholly inapt for this court to have interpretation of the orders passed by the Apex Court, the way petitioner is desirous to be done. Thus in my opinion proper course for the petitioner would be to approach the Apex Court itself in case he feels the order passed by the Apex Court conveyed what is sounded by him in terms of instant revision petition," the Principal District Sessions Judge Rashid Ali Dar said. "I am of the view that the revisionary jurisdiction can not be exercised by this forum to upset the order dated 14-9-2013 passed by Chief Judicial Magistrate Srinagar," the court said and rejected the revision petition. On September 14, Chief Judicial Magistrate Srinagar had allowed the application moved by Director General of BSF seeking trial of Commandant R K Birdi and Constable Lakhvinder Kumar in GSFC. Zahid Farooq died after he was allegedly hit by bullets fired by BSF Constable Lakhvinder Kumar on the directions by Commandant near Brane Nishat in Srinagar on February 5 in 2010. Subsequently, the BSF Constable Lakhvinder and his Commanding Officer, Randhir Kumar Birdi, of 68 Battalion were arrested on charges of murdering Zahid. |
