Court awards 1 year imprisonment to lady for illicit relationship

KISHTWAR, June 11: Principal District and Session Judge Kishtwar Pawan Dev Kotwal today awarded one year rigorous imprisonment to a lady and her paramour while acquitting her parents.
30 year old Sushma Devi wife of Naib Chand and Daughter of Krishan Lal and her 32 year old paramour Ashwani Kumar, resident of Bhatkot, Kuntwar were sentenced for one year rigorous imprisonment for incitement while parents of the convicted women Krishan Lal and his wife Gayatri Devi were acquitted by the court.
As per the details, complainant Naib Chand son of Puran Chand lodged a complaint before Chief Judicial Magistrate Kishtwar U/S 494/498/109 RPC stating that Sushma Devi daughter of Krishan Lal is his legally wedded wife. He said after remaining together for 8 to 9 years, his wife left her house with the pretext that she will go to her parent's house and will return back after 2-3 days.
He said that after she left his house, she did not return back and started residing with her parents. He said that on February 22, 2008; his legally wedded wife married with Ashwani Kumar by her parents without giving divorce to him. After recording the statement of the complainant and two other witnesses on oath, CJM Kishtwar issued the notice to the respondent who pledge not guilty and decided to contest the charges and accordingly CJM Kishtwar forwarded the case to Principal District and Session Judge Kishtwar for trail.
After trail of nearly five years, the court of Principal District and Session Judge Kishtwar found them guilty U/S 498 RPC and awarded them one year Rigorous Imprisonment and a fine of Rs. 20000 each. In case of non deposition of fine, both the accused will undergo six month further imprisonment.
However the complainant failed to prove the remarriage allegation against his wife who had alleged given birth to a daughter out of her relationship with her paramour. While pronouncing judgment, Principal District and Session Judge Kishtwar quoted various judgments delivered by High Courts of the country from time to time. The court also gives the bail to both the convicted persons till 11-7-2014 subject to proper bail from the High Court.
