Add all offences made from nurse's statement: Court to police | Sexual Assault Case | | Early Times Report
Srinagar, June 14: A local court here today directed police officer, investigating the sexual assault allegation among others on Director Health Services Kashmir to add all offences as are disclosed against the accused in light of the statement by the complainant nurse. Disposing of an application, Chief Judicial Magistrate Srinagar, V S Bhou also directed the IO to File latest status report of investigation into the case within ten days. For supervising the investigation as demanded by the victim in her application, the CJM observed that "within text and whoop of supervisory powers" conferred upon it to supervise investigation it can pass direction for fair investigation and also to supervise the investigation in its limited perspective. Regarding demand for FIR, the CJM said the FIR has already been registered and it is only pre investigation on basis of collection of evidence that offences may be added or deleted. Last week, the nurse, posted in south Kashmir's Anantnag district, lodged a complaint against Director Health Services and three other officials in Police Station Shaheed Gunj here, alleging that they tried to rape her. In the complaint, the victim has named Dr Saleem-ur-Rehman (Director Health Kashmir); Dr Nazir Shadad (CMO Anantnag); Dr Arshid Tak (BMO Sallar) and Dr Ashraf (Incharge Medical Superintendent Seer Anantnag) as the accused. In her compliant, she has alleged: "The SHO concerned appears to be under influence of the accused and has not been conducting the investigation in a fair and transparent manner. The complaint is not being taken cognizance of in its real spirit and scope which has prejudiced the legal rights of the complainant and in the process a wrongful gain is being provided to the accused". The complaint reads that the accused are guilty of very serious misconduct and the allegations against them are "penal in nature but the police is brushing aside the seriousness of the allegations and are helping the accused in fleeing from burnt of investigation." |
