Husband gets 1 year imprisonment for torturing wife

Jammu, July 11: Principal Sessions Judge Jammu RS Jain today awarded one year imprisonment and fine Rs 2000/- to Subash Chander who was booked by the police for torturing his wife for dowry, after 14 years trial and investigation. Prosecution case against respondents (hereinafter referred to as the 'accused') SubashChander, Meemo Devi, Rekha Devi, Bholi Devi and Shamsher Singh is that on the basis of the complaint of Balwan Singh filed on 27.4.2000 in police station, FIR No.77/2000 was registered in police station Akhnoor and challan was presented against the accused with the allegations that accused SubashChander was married to Bindu Devi daughter of the complainant about 1 year and 4 months back and that the accused used to harass his daughter for dowry and torture and beat her also. Accordingly, finding the accused guilty of offence u/s 498-A RPC, the challan was presented against the accused persons. Accused were charged for offence u/s 498-A RPC. They denied their guilt and claimed trial and trial Court acquitted all the accused against which appeal has been filed in the Sessions Court.
Principal Sessions Judge Jammu RS Jain after hearing both the sides hold that the prosecution has succeeded in proving that the accused Subash Chander had treated the deceased with cruelty and made repeated demands of dowry items. Thus the prosecution has succeeded in proving beyond reasonable doubt that accused Subash Chander has committed offence under Section 498-A RPC and accordingly he is convicted for offence u/s 498-A RPC. Accordingly, accused Subash Chander is sentenced to undergo simple imprisonment for period of one year and also sentenced to a fine of Rs.2000/-. (JNF)
