HC stays Recruitment of 1657 Assistant Professors

JAMMU, July 23: The recruitment of Assistant Professors in Government colleges against 1657 posts is once again caught in legal tangles as the Srinagar High Court has again stayed the recruitment process.
Sources informed Early Times that High Court Jammu had directed the Jammu and Kashmir Public Service Commission (JKPSC) not to make recruitments against 1287 posts of Assistant Professors, which were advertised as per first notification, in response to the petition filed by M.Phil candidates of Jammu division.
"Though the High Court (Jammu division) had not stayed the recruitment process but in response to petition filed by M.Phil candidates of Srinagar, the Srinagar division of High Court had stayed the recruitment process around 15 days back", sources said.
They further informed that on Wednesday, the lecturers working in Higher Secondary Schools also secured stay on the recruitment process. "The 1657 posts were advertised as per three notifications. In the first notification only 1287 posts were advertised and according to that notification, the upper age limit for Higher Secondary lecturers was 45 years but as per third notification in which 1657 posts were advertised as per new recruitment rules, the age limit is 40 years", sources said, adding that the third notification was challenged by Higher Secondary lecturers working in Srinagar, and they had secured stay.
Sources further said that Higher Education Department was the first respondent, while JKPSC was the second respondent in the petition filed by M.Phil candidates and Higher Secondary lecturers, and till there would be some relief from High Court, the process would remained stopped.
An official of PSC said that it was the prerogative of Higher Education Department to contest the decision of High Courts. "It would take some more months to complete the recruitment process", the official said.
He further said that the petition filed by M.Phil candidates would be dismissed by High Court, as the first two notifications advertising the posts, have been withdrawn by the Higher Education Department and it was the only third notification, according to which 1657 posts have been advertised, was valid.
Pertinently, in the last week of May, 2014, the JKPSC had issued third notification for the recruitment of 1657 Assistant Professor in various disciplines in the Government Degree Colleges. According to that notification, the Ph.D, NET and SLET qualified candidates were eligible for filling the forms and not the M.Phil candidates.
Though the M.Phill candidates had secured stay from High Court but JKPSC had not allowed the M.Phil candidates to fill the forms, alleging that the Court decision was ambiguous.
