Court acquits Patwari in trap case as VOJ fails to prove case | | | Jammu, July 28 : Special Judge Anti-Corruption, Jammu, Puneet Gupta has acquitted Mustaq Hussain, a Patwari in revenue department, from the charges of a trap case as VOJ has failed to prove the case against him. According to the VOJ case, one Vijay Kumar lodged a written complaint with the P/S VOJ against Mustaq Hussain Patwari, alleging that he had demanded Rs 20,000 from him as bribe and deal was settled for Rs 15000 in lieu of demarcation of land which was purchased by him in the year 2003. On this, VOJ registered a case and constituted a trap team and caught Mushtaq red-handed while accepting the bribe amount and after completion of investigation challan was presented. After hearing the two sides, the judge observed that from the prosecution evidence and the evidence produced by the defence it is clear that some persons were present on the spot and the when the raiding team entered the office of the accused, it did not allow the person to be part of the trap proceedings and falsely implicated the accused in order to give colour of genuineness to the complaint. It cannot be ruled out, the court said and observed that VOJ had failed to prove that the accused had demanded and accepted the illegal gratification from the complainant and the amount had been recovered from him. With these observations, the court acquitted the accused from the corruption charges leveled against him. JNF |
