Man gets life sentence for killing wife | | | Early Times Report
Jammu, July 28 : Principal Sessions Judge, Jammu, Rakesh Sagar Jain today awarded life-imprisonment to Tara Chand, son of Shiv Ram of Patoli who was facing trial in the murder of his wife Raj Kumari for the last 7 years. According to the police case, on February 13, 2007, in the evening she asked her husband for money for household purpose as a result of which a fight started between them. Next day, she was taking out the flour from the kitchen to prepare food at about 5 am when her husband poured kerosene oil on her and set her on fire. The accused closed the door of the kitchen from outside. She opened the latch and went to the roof of the house and her husband covered her with a blanket whereby the fire got doused. Her brother-in-law Nittu Kumar got an autoricksha in which she was brought to the hospital. Her husband and mother-in-law did not come to the hospital to enquire about her. She gave the statement on her own free will and without fear or coercion and signed it in English. Accordingly, FIR No.22/2007 for offence under section 307 RPC was registered at police station, Bakshi Nagar. On February 18, 2007 Raj Kumari succumbed to her injuries and offence against Tara Chand was converted from Section 307 RPC to Section 302 RPC and after completion of investigation challan was presented. After hearing the two sides, the judge observed that awarding sentence in our civilized society; a reasonable proportion has to be maintained by the Court between the heinousness of the crime and the punishment. The sentences are imposed to reflect the seriousness of the crime, to promote respect for the law, to provide just punishment for the offence, to afford adequate deterrent to criminal conduct and to protect the community from further similar conduct. In awarding sentence the court must look into the crime, the victim besides the circumstances of the criminal and the impact of the crime on community and keeping in view the age of the accused, imprisonment for life shall be adequate sentence in the present case. Accordingly, accused Tara Chand is sentenced to undergo imprisonment for life and a fine of Rs 6000 for offence under section 302 RPC in causing the murder of Raj Kumari. JNF |
