Court dismisses appeal of CBI | Acquittal of then Head Cashier PNB | | Jammu, July 30 : Principal Sessions Judge Jammu RS Jain dismissed the appeal of acquittal of Bansi Lal Zijoo the Head Cashier in PNB MaharajGanj, Srinagar who had allegedly misappropriated Rs 2 lakh in the year 1979 and was booked by CBI and acquitted by CJM Jammu on October 30, 2012. Against the acquittal CBI filed present appeal in the court of Principal Sessions Judge Jammu. The allegations against the accused being that he was working as Head Cashier in Punjab National Bank (hereinafter referred to as 'PNB'), MaharajGanj, Srinagar in the year 1979. As Head Cashier accused was in charge of cash transaction in PNB, MaharajGanj. On 9.2.1979, an amount of Rs. 6 lakh was remitted from PNB MaharajGanj to PNB Amirakadal as excess cash. This amount was carried by accused to PNB Amirakadal. Instead of depositing the total amount of Rs. 6 lakh, accused deposited an amount of Rs. 3,89,500 in PNB Amirakadal, credited back Rs. 10500/- in PNB Maharaj Ganj, thus accounting for Rs. 4 lakh out of Rs. 6 lakh which he carried for depositing on that day. The balance amount of Rs. 2 lacs was misappropriated by the accused and to cover up the misappropriation, accused prepared and passed unauthorizedly a transfer voucher for Rs. 2 lakh on 08.11.1979. In this manner accused misappropriated an amount of Rs. 02 lacs out of money entrusted to him on 09.02.1979. Principal Sessions Judge Jammu RS Jain after going through the case observed that no application has been filed by the State for condoning the delay in filing the appeal. The application filed by the State seeks grant of leave to file the appeal. In view of the facts and circumstances of the case, it is apparent that the present appeal has been filed beyond the period of limitation. Hence, the appeal cannot be admitted for hearing and is accordingly dismissed.(JNF) |
