HC suspends sentence, grants bail to former EO Katra 7/31/2014 11:06:27 PM Jammu, July 31 (JNF): In a Criminal Appeal filed by Sham Lal then Executive Officer Katra Municipality who was awarded one year imprisonment by the Additional Sessions Judge Anticorruption Jammu on July 24, 2014 in Disproportionate Assets Case, Justice Janak Raj Kotwal of J&K High Court Jammu Wing after hearing Sr. Adv PN Raina with Adv Sindu Sharma appearing for the petitioner issued notice to State and Ors returnable within two weeks and issued direction to the Registry list this case immediately after service is complete. In the meanwhile, Justice Janak Raj Kotwal ordered that execution of sentence shall remain suspended and appellant shall be released provided he furnishes personal bond in the amount of Rs 20,000 along with a surety in the like amount to the satisfaction of Registrar Judicial. According to the VOJ against Sham Lal the then Executive Officer NAC Katra for possessing disproportionate assets to his known source of income to the tune of Rs 18, 76, 756/-. accused during the period from 1977 to December, 1995 acquired assets disproportionate to his known sources of income whereas the counsel appearing for the accused argued that the accused has income from hotel and other immoveable properties but the investigating officer has not considered the same and there is variation in his income from time to time but its benefit has not been given to the accused. According to the Senior Public Prosecutor appearing for the VOJ said that as been found in possession are in the shape of landed property, house at Katra, Hotel Swastik, Maruti Van and other immoveable assets. It has been found during investigation the assets in possession of the accused disproportionate to his known source of income are of value of Rs 18, 76, 756/- for which the accused satisfactorily account for. On September 29, 2007 , court framed charges u/s /s 5(1) (e) r/w section 5(2) PC Act 2006 and sections 9/11/12/14 of the J&K Public men and Public servants declaration of assets and other provisions Act 1983.   Share This News with Your Friends on Social Network     Comment on this Story
