DB directs CS to constitute a High Level Committee Admission to trans-gender children in private school 8/21/2014 11:36:16 PM Jammu, Aug 21: In a PIL filed by Haji Miya Saria seeking direction to the respondents to ensure compliance of Fundamental "Right to Education" in letter and spirit and also seeking direction to private educational institutions do not discriminate qua the "Trans-Genders" for the purposes of admitting them in Education Institutions while treating them as aliens. A Division Bench of State High Court Comprising Justice Virender Singh and Justice Tashi Rabstan after hearing Advocate DS Chouhan with Adv Meharban Singh for the PIL whereas Sr. AAG Gagan Basotra appearing for the state, directed Chief Secretary of J&K State to constitute a High Level Committee under his chairmanship as already proposed without any waste of time, preferably within two weeks' time only by including all other officials who can render proper assistance to him for the purposes of formulating a comprehensive scheme for addressing the problems of transgenders of the State strictly in tune with the directions contained in Writ Petition (Civil) No.400 of 2012 in which undoubtedly he would also call for the recommendations of the Expert Committee already constituted under the aegis of the Ministry of Social Justice and Empowerment if not send till date. He shall also join one of the representatives of the transgender community of the State who would place before the Committee the problems being faced by them for their redressal strictly directions of Supreme Court so as to achieve the cause. Division Bench also exempted personal appearance of Commissioner/Secretary GAD for today and deal with the subject matter considering the compliance report filed by him. Division Bench directed Sr. AAG Gagan Basotra shall appraised the court of the compliance of the order on next date of hearing.
