Srinagar, Aug 22: The High Court today directed government to ensure handing over of possession of Flat No 43, Doulat Building, Colaba, in Mumbai meant for the accommodation of Joint Resident Commissioner (JRC), Mumbai, to the present serving official within two weeks. Hearing a petition filed by present JRC Javid Ahmad Shah, High Court Judge Ali Mohammad Magrey directed that Principal Resident Commissioner, J&K Government, 5-Prithvi Raj Road, New Delhi, shall remain present in person in case government fails to do so. "Principal Resident Commissioner is directed to file his personal affidavit indicating the steps taken for ensuring eviction of respondent No 5 (Asif Hamid Khan) from the official accommodation unauthorisedly occupied by him before next date of hearing," the court said and posted the case for next hearing on September 5. In his petition, Shah has sought direction to the state government to take back the possession of the the Flat No 43 Doulat Building Colaba, Mumbai and hand it over to him to occupy it as Resident Commissioner, Mumbai. Shah's counsel submitted that pursuant to govt order No 974-GAD of 2011 dated 24.08.2011, he was transferred and posted as Joint Resident Commissioner, J&K government, Mumbai. Consequently he joined the post and is discharging his duties to the satisfaction of the respondents. He said the government of J&K long back had hired Flat No 43 Doulat Building Colaba, Mumbai, which is being used as residential accommodation for JRC, Mumbai. He said Asif Hamid Khan during his long tenure posting as Joint Resident Commissioner, Mumbai occupied the Flat and on his transfer as Additional Resident Commissioner, Delhi, he did not vacate the premises to enable the petitioner to occupy the same in his capacity as JRC, Mumbai. Before filing the petition, Shah had approached the authorities concerned and also requesting Khan to vacate the premises and allow him to occupy it for his residential accommodation but failed in his continuous efforts.
