Court acquits 7 in bomb blast case

Jammu, Aug 22 : Principal Sessions Judge, Poonch, JafferHussainBeigh has acquitted seven accused who were facing trial in a bomb blast case.
The accused included Wallayat Khan, Abdul Aziz, Wazir Mohammad, Mohammad Jameel, ZakirHussain, Mushtaq Ahmed and Mohammad Yousaf. Five persons were killed and at least nine others wounded in the blast that had taken place on Traranwali Road near Surankote on April 21, 2009.

Fozia, Mohd Bashir and MohdIrshad got seriously injured on 21.4.2009.
According to the police case, a report was lodged on April 4, 2009, after
receiving information through a reliable source that the militants Abu Ali, Abu Kitaal, Majeeb Ali code R7, UjafaSaqib code Z2, Osama Doctor alias Israr of Pakistan, Farooq code Zulkurnain and Liaqat code Umer Hayat of Doda, after hatching criminal conspiracy allegedly with Wallayat Khan, Abdul Aziz and Wazir Mohammad with the common criminal intention, exploded an IED at about 4 PMonTraranwali road when a Tata Mobile (1795/JK12), driven by AshiqHussain, that was coming from Lower Murrah, Surankote, to Murrah passed from there. In the explosion, Mohammad Rafiq, AshiqHussain, ShahienAkther, AnisaKouser and Headmaster Ghulam Ahmed travelling in the vehicle were killed on the spot while Mohammad Hanief, son of Mir Mohammad, Mohammad Fazal, MohammadHanief, son of Suleman, JavedIqbal, Lal Mohammad, MajidMajied, Fozia, Mohammad Bashir and Mohammad Irshad received serious injuries.
Wallayat Khan, Abdul Aziz and Wazir Mohammad had allegedly helped the militants in installing the IED. The militants who have waged war against the Government of India had blasted the IED and caused loss to the human lives. On receiving this information FIR No.58/2009 for offence u/Ss 302, 120-B RPC and 3/4 ESA was registered and after completion of investigation challan was presented.
The principal sessions judge, after hearing the two sides, observed that there is no direct evidence to connect the accused with the crime because all the injured and the eyewitnesses have not supported the prosecution at all.
There is also no indirect evidence to connect the accused with the crime because the prosecution has totally failed to prove any of the disclosure statements made by the accused and the recovery thereof. There is also no evidence of any circumstance on record to connect the accused with any crime. When the prosecution has not succeeded in bringing home the guilt of the accused, there is no need to discuss the defence set forth by the accused and the evidence led by them. With these observations, he ordered to acquit the seven accused.
The judge also issued General Arrest Warrants against militants Abu Ali, Abu Kitaal, Majeeb Ali code R7, UjafaSaqib code Z2, OssamaDr alias Israr of Pakistan, Farooq code Zulkurnain and Liaqat Code Umer Hayat of Doda. (JNF)
