Bail granted to husband in 'sexual abuse, harassment' case

Jammu, Aug 29: A local court today has granted the bail to the alleged accused - husband facing offence under section 498-A/377/109 RPC following a complaint from his wife.
The accused namely Tajinder Sethi was booked by the Bakshi Nagar Police on the base of the complaint lodged by his wife who had alleged that her husband tortured her physically and sexually for the want of dowry. "During investigation, the statement of the complainant in terms of section 164-A, CrPC was recorded and accordingly offence under section 377/109 RPC was added, police sources said.
During hearing councilors namely Himanshu Beotra and Hemanshu Mahajan appearing for accused before the Sub Judge JMIC ,Jammu termed the case as false and frivolous as 377 /109 RPC was added much later, which itself shows some fishy and is clear case of abuse of process of law.
After hearing the councilors of accused, the court observed, "The court is of the opinion that prima facie case has been made out for grant of bail to the accused person. "Accordingly accused is admitted to bail subject to furnishing of personal bonds in the sum of Rs 20,000 and surety bond like amount, couple with the conditions that he shall fully cooperate with the IO and apper before the IO as and when required by the IO". Earlier the court turned down the plea submitted by the Sr P/O for the state to the effect that accused person will jump over the bail or temper with the prosecution evidence saying it is not well founded as the investigation of the case is almost complete and the offence is not punishable with death or imprisonment for life, therefore provision under section 497 A CrPC are not applicable in present case
