SIC castigates SSRB , asks to provide information with 15 days

Srinagar, Aug 30: While castigating State Services Recruitment Board (SSRB) , State Information Commission (SIC) has issued a notice,asking it for compliance report for implementation of section 4 of J&K RTI Act within 15 days .
Under section 4, public authorities have to voluntary (suo-moto) disclose information and keep it in public domain on the official website. The order was issued on the directions of Chief Information Commission (SIC) G R Sufi after hearing an unemployed youth from Poonch who was denied information by SSRB about the selection of teachers. His name had not figured in the list.
Tousif Ahmad Bhat filed an RTI application on February 4, 2014 before PIO, SSRB, seeking information about the marks obtained in the written examination and cut off marks of the RBA category for District Poonch for the selection of government teachers . The applicant also sought a copy of his answer book.
The PIO informed the Commission that the appellant had applied for the post of teacher as well as VLW, District Cadre Poonch, for which a common written examination along with other posts was held on September 17, 2013. He said on February 11, 2014he informed the appellant that the selection process was incomplete, hence information cannot be provided and it would be provided as and when final selection process is completed for all posts.
Aggrieved by the order of PIO, the appellant preferred first appeal before First Appellate Authority (FAA) , J&K Service Selection Board on March 7, 2014. The First Appellate Authority passed an order on April 17, 2014, upholding the plea of PIO that the selection process was incomplete. However, the information seeker was assured that the information will be provided to him as and when the selection process is completed. Again aggrieved by the order of FAA, the appellant filed 2nd Appeal in the State Information Commission (SIC) on 30-06-2014. The PIO submitted before the Commission that selection list for the post of Teacher is complete and result of the same has been declared. However, appellant had also applied for the post of Village Level Worker(VLW) , District Cadre Poonch for which viva voce has not been completed yet. Hence information could not be given to the appellant.
It is obvious from the record that selection process for about 400 posts of teachers has been completed in which about 10,000 candidates appeared in written examination whereas selection process for mere six posts of VLWs is surprisingly still incomplete. The appellant claims to be a resident of remote area of Poonch District belonging to RBA category.
"The Commission has noted that there was no reasonable cause for the SSRB which is a premier organization responsible for selection of candidates for Non Gazetted aspirants for the jobs as to why selection for lesser number of posts has not been done yet. It is surprising that selection for mere six posts of VLW is yet incomplete, whereas, the process of selection of 400 teachers has been completed. Keeping the selection of mere six candidates in indefinite abeyance is definitely causing an obstruction in establishing the regime of transparency and accountability in the working of public authorities. This obviously gives reason for apprehension with regard to the transparency of the selection process. The selection of rightful aspirants for the jobs in a transparent manner is of utmost importance. As there is no cause given to the Commission for non completion of selection process of six candidates for the post of VLW, therefore, Commission in order to uphold the objects of J&K RTI Act, 2009 to bring transparency and accountability in the working of public authorities with regard to their various functions particularly the noble functioning of selecting rightful candidates to the jobs directs PIO, JKSSRB to provide information to the appellant within a period of 20 days from the receipt of this order" reads the August 14, 2014, SIC order.
