Woman, 2 others acquitted in murder case

Jammu, Aug 31: Principal sessions judge, Poonch, Jaffer Hussain Beigh has acquitted a woman in the murder of her husband along with two others.
Those acquitted included Zanib Bi, Mohammad Ashraf Bhat, son of Jamal Din, and Noor Din, son of Abdullah Sheikh. All were undergoing trial in the murder of Zanib's husband Amir Din and have been acquitted as the court observed that there was neither direct nor indirect evidence against them.
According to the police case, a report was lodged by Sultan Mohammad that On December 5, 2010 at about 8.30/8.45 p.m when he returned from a marriage, he heard a hue and cry. Zaitoon Bi, the daughter of the deceased, was crying that her father has been murdered by some persons. He went to the spot and saw the body lying in front of the house. Police on patrol duty also came to the spot. The accused were also present on spot. They are residing inside the fencing wire and are not allowed to come out from that boundary without permission. Report was lodged on the next morning and Zaitoon Bi allegedly told that she watched from the rooftop accused murdering her father Amir Din.
Amir was residing in Jammu for the last 13/14 years because his wife was having illicit relations with other persons. The deceased was brought home by the children but then there was a quarrel between the deceased and her wife. Zaitoon Bi came to house prior to the day of the crime and said that her mother had killed her father. She ran and saw the deceased lying on the cot and the accused Zanib Bi was throttling him but on seeing her she removed her hands from the throat of the deceased.
The wife of the deceased also warned that in case the deceased cause any interruption in her illicit relation it would be dangerous for him. On the day of the crime after finding the chance the accused committed murder of the deceased. The accused Noor Din was the Imam and was also providing 'taveez' to people while the accused Mohammad Ashraf was a tailor at Chaprian. Both of them were alleged to be having illicit relationship with Zanib Bi and the deceased was prohibiting them for visiting his house.
After completion of investigation, police presented challan in the court. After going through the statements of the witnesses, the judge observed that there is neither direct nor indirect evidence against the accused which means that there is no evidence adduced by the prosecution in order to connect the accused with the commission of the crime attributed to them. It is very difficult to agree with the prosecution that the accused were present at the scene of offence and have committed the act for which charges have been framed against them. Since the testimony of the eyewitnesses has not supported the prosecution case at all and have not connected the accused with the crime, the result is that the accused persons are acquitted of the commission of offences they were charged with.
