HC upholds selection of Inspector in I&CD | | | Early Times Report
Jammu, Sep 1 : In a writ petition filed by 3 d candidates who had applied for the post of inspector in Industries & Commerce department, the Hon' ble High Court decided an issue of constitutional importance. While repelling the contentions of the writ petitioners about the allocation of arbitrary and high marks in the interview process, the High Court observed that since the petitioners have participated in the process of selection with full knowledge as regards the criteria fixed by the Board ,they cannot be permitted to turn around and challenge the same" after failing. The Justice D.S Thakur after hearing .C M.Koul Advocate for the petitioners and / K.M. Bhatti and Anil Sethi for the board and the selected candidates observed that in view of the law laid down by the Supreme Court of India, the non selected candidates cannot challenge the criteria, once they have participated in the selection process. While repelling the other pleas of the petitioners as regards exaggerated marks having been given to the selected candidates, court observed that the interview committee comprised of 3 members who had distributed equal marks amongst themselves for the purpose of fixing the marks allotted to all the competing candidates. |
