File reply over plea challenging validity of law restricting sealing: DB to respondents | | | Jammu, Sept 16 (JNF) : In a petition filed by Jaspinder Singh challenges the constitutional validity of an Act passed by the State Legislative Assembly of Jammu and Kashmir popularly known as the Jammu and Kashmir Civic Laws (Special Provision) Act, 2014, Division Bench (DB) of State High Court comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur directed State to file reply before the next date of hearing failing which matter shall be heard without reply. After hearing Adv Ajay Sharma and Adv Parag Sharma for the petitioner, Division Bench (DB) of State High Court comprising Chief Justice MM Kumar and Justice Dhiraj Singh Thakur, directed respondent to file objections before the next date of hearing because the Deputy Commissioner Reasi is state to be busy in arranging help and aid for the poor people on account of unprecedented situation created by floods. Pertinently the main challenge to the Act is based on the argument that the Act does not take away the base of any judgment, order or direction issued by this Court but the legislature is acting as an appellate authority and petitioner also has referred various judgments of Supreme Court including very important judgment of Keshvananda Bharati v. State of Kerala. |
