Officers to pay compensation of Rs 1lakh along with interest @ 6% pa to complainant

Jammu, Sept 18: The Court of Additional District Judge Jammu has passed decree against seven top officers posted in different departments in Jammu and Kashmir state including Vigilance, officers in Postal Department, a senior most bureaucrat and Secretary to Government of India. The decree came to an effect when most of the officers have attained superannuation.
The officers included Chief Secretary, Jammu and Kashmir State, Secretary to Govt of India, P&T department, S.M Desalphine, Commissioner Vigilance, Raj Karan Sharma, DySP Vigilance Organization, Romesh Chander Sharma Sub Post Master, H.L Sabharwal Sub Post Master and L.R Kotwal,Sub Post Master.
As per order, "A decree for compensation of Rs one lakh along with the interest @ 6% per annum from the date of the suit till the realization is passed in favour of plaintiff (complainant) and against the defendants (top officers). Complainant is further entitled to cost the suit . All defendants are jointly and severally liable".
The court issued order when one Suman Mala, who is teacher by profession posted in Kendriya Vidyalaya, w/o Vijay Kumar Gupta of Trikuta Nagar, Jammu, filed suit against the seven top officers stating that his son's career was spoiled by them and even the officers did not concede with the court's earlier order.
The complainant said that, her husband was booked by Vigilance department under FIR No 26/97 u/s 5(2) PC Act. While the case was under trial, her son namely Anshul Gupta was selected for BE Course in Karnataka State. For course, a sum of Rs one lakh was urgently required for admission and other expenses. To meet the expenses, she went to the Post Offices in Bakshi Nagar, Dhounthly Bazar and Old Hospital road to withdraw the amount she had deposited in the shape of Kissan Vikas Patra from her own pocket. But,there she was told that the case of KVPs is pending with the Vigilance Organization. The complainant later, through counsel served the notice dated 6.8.99 under section 80 CPC upon the officers in question through registered post calling upon them to make the payment of Rs one lakh as compensation within two months from the date of receipt of the said notice, but despite of the receipt the said notice was ignored. After going through the case, the Addl District Judge ,Jammu court observed, " A decree for compensation of Rs 100,000 along with interest @ 6% pa from the date of suit till realization is passed in favour of plaintiff and against the defendants. Plaintiff is further entitled to costs of suit. All defendants are jointly and severally liable. Office is to frame decree sheet accordingly. File is consigned to record after compilation."
