PIL seeking prohibition of using Parade playground as parking lot
DB Directs Commissioner JMC to file affidavit

Jammu, Sept 30: In a Public Interest Litigation filed by Shambu Nath then Vice Chairman J&K Cricket Association and Laxmi Cricket Club Jammu seeking direction to respondents for prohibition of using parade playground as parking slot or any usage other than playing, by the general public and Govt officials, a Division Bench of State High Court comprising Justice Virender Singh and Justice Dhiraj Singh Thakur directed Commissioner JMC that he shall file an affidavit within three days from today to the effect that that play ground is no longer permitted to be used as parking place and shall not be used for that purpose in future also.
While directing the Commissioner JMC and IG Traffic, Division Bench observed that with a view to verify as to whether the Parade playground is being used Generally as a parking place or not, it is deemed necessary to appoint a Court Commissioner who shall go on spot and report the exact status and accordingly Advocate YE Tak appointed as Court Commissioner, who shall visit the spot today and submit report regarding the same in the registry within a period of two days.
Division Bench further directed that in the meantime Advocate SS Nanda appearing for the JMC to ensure that no vehicles are permitted to be parked in the Parade Ground which was being used as play filed by the Children. This direction shall be carried out by the Commissioner JMC, IGP Traffic J&K, shall render all assistance to the Commissioner, Jammu Municipal Corporation for implementation of this order. (JNF)
