HC rejects bail application by Mushtaq Peer | | | Early Times Report
SRINAGAR, Oct 1: A Division Bench of J&K High Court today rejected bail plea by former BOPEE chairman Mushtaq Ahmad Peer, the main accused in the Common Entrance Test -2012 question paper-selling scam. "The investigating agency is still investigating the involvement of other conspirators and therefore at this stage grant of bail shall be detrimental to further investigation of the case regarding other conspirators," the division bench comprising Chief Justice M M Kumar and Justice Mohammad Yaqoob Mir said while rejecting bail application filed by Peer. "Allegedly lakhs of rupees have changed hands which facilitated the fraudulent selection of number of candidates pursuing the course of MBBS, BDS, etc. The merit has become causality. The aspiring candidates after exposure of this fraud got disheartened. It will take time to repair loss and restore faith in CET," it observed. "The magnitude of the fraud committed can be gauged from other angle i-e money power will have preference over all others. The merit, hard work, genuine hope, expectations and fair selection have become causality," the court said, underling that the observations made are simply to highlight as what is the heinous of the crime allegedly committed by Peer and to show how societal interests are damaged. In case Peer is suffering from any ailment, the court said, concerned jail authorities shall take all steps to ensure given proper medical aid. Jammu, Oct 1: In a Criminal Revision Petition filed by Puneet Chopra, seeking quashment of the order passed by Principal Sessions Judge, Jammu, regarding closure of evidence in the much publicized Chopra murder case, high court judge Tashi Rabstan observed that counsel for the petitioner during the course of argument fairly stated that the prosecution had filed application under section 540 of CrPC (recalling of prosecution witnesses), and deferred the consideration of this criminal revision till application filed by the prosecution under section 450 of CrPC is considered and decided by the trial court. The court also directed trial court to dispose of the said application without proceeding further in trial, preferably before October 10, 2014. |
