SIC directs CAPD for proper calculation of Xerox fees
RTI applicant charged whopping Rs 50,400 for information

Jammu, Oct 19: The department of Consumer Affairs & Public Distribution Department (CAPD) district Doda has charged a whooping amount of Rs 50,400 from an information seeker on account of xerox charges for seeking information related to sale depots and private dealers operating in Doda district.
As per details available with Early Times one Naseeb Singh S/o Tara Chand R/o Dool, Nagseni Tehsil & District Kishtwar moved an application dated 20-01-2014 before the Public Information Officer/Assistant Director, CAPD Department Doda under Jammu & Kashmir Right to Information Act, 2009 where-under he sought certain information about Sale Depots and Private Dealers existing and functioning in District Doda.
Feeling aggrieved of inaction on the part of the Public Information Officer (PIO) , the appellant filed 1st appeal dated 19-03-2014 before the 1st Appellate Authority ie Director, CAPD Jammu which was disposed of vide order no. 169/G/RTI/Appeal-59/CS/256-256(a)/(A) dated 17-05-2014. The record show that the appellant was directed by the Asstt. Director, CAPD Doda vide letter no. 987-90/CAPD/D/2014 dated 10-02-2014 sent through registered post on 11-02-2014 to deposit an amount of Rs. 50,400/- into Govt. Treasury on account of cost of photo-stat charges of relevant information. The appellant deposited the said amount on 26-05-2014 and accordingly the PIO (Asstt. Director) CAPD Doda directed the concerned staff to formally prepare the information which was voluminous in nature and furnish the same to the information seeker. The PIO/Asstt. Director, CA&PD Deptt, Doda furnished the requisite information to the information seeker vide office no. 916-18/CAPD/D/2014 dated 23-08-2014 under a registered cover to the information seeker. The said letter was taken on record for reference during the course of proceedings held at SIC office Jammu on October 13th 2014 . The information seeker apprised the Commission during the case hearing that he has received the information sent by the PIO/Asstt. Director, CAPD Doda . Satish Kotwal, TSO, Doda who appeared on behalf of Ghulam Rasool, Asstt. Director, CAPD Doda assured the Commission that another set of information has already been dispatched to the information seeker under a registered cover on 06-10-2014.
"However, the PIO/Asstt. Director, CA&PD Deptt, Doda is hereby directed to determine the cost of information after calculating the number of pages furnished to the information seeker and refund the amount if any, charged in excess from the information seeker within two weeks from the date of receipt of this order under intimation to the Commission. The appeal is accordingly disposed of. Notice of this decision be given free of cost to the parties" .
