SIC directs Jammu police to provide revised information under RTI to retd CMO

Jammu, Oct 21: The State Information Commission (SIC) seems to have come to the rescue of a retired Chief Medical Officer (CMO) by directing the Jammu district police to provide him some information related to an FIR which was registered in Channi Himmat police station around two years back. The retired CMO also wanted some information related to FIR's registered against two brothers who hail from Chatta at present Uttam Nagar Gangyal . The said information wasn't provided by the police and the SIC has now given clear orders to the police for revealing all the information under Right to Information Act (RTI). As per details available Dr R P Singh, retired Chief Medical Officer who hails from Talab Tillo, Jammu, moved an application under RTI Act on October 7, 2013, before Public Information Officer (PIO) in the district police office, seeking a copy of form Mazroobi (Injury Form) in case FIR No 100/12 at Channi Himmat police station with the name and number of officials who accompanied the injured to hospital and the report of the daily diary regarding the same. He also asked for a copy of the medical report provided by the hospital or doctor in the above mentioned case and the number of criminal cases registered against Zakir Hussain and Ashiq Hussain, sons of Qasim Din of Uttam Nagar, Gangyal, in the south police jurisdiction with effect from 1985 to till date. The two brothers originally hail from Chaata.
Feeling aggrieved by the response of then SDPO East, Jammu, vide his November 9, 2013, letter No RTI/SPCS/70/13/23863, the appellant filed 1st appeal on February 26, 2014, before the 1st Appellate Authority, ie S P South, Jammu. In the 1st appeal, the appellant alleged that the information provided by the PIO was incomplete regarding the criminal cases registered against Zakir Hussain and Ashiq Hussain. The 1st Appellate Authority vide letter No 3588-90 dated March 24, 2014, informed the information seeker that the information sought by him has been obtained from S.P. City (South), Jammu which consisted of 10 leaves. The same was to be collected from the office after depositing the requisite fee in the government treasury. After that the appellant preferred 2nd appeal on April 25, 2014, before SIC wherein he alleged that the information provided to him is incomplete and incorrect and not as per his RTI application and requested the commission that PIO be directed to furnish the complete information as sought in the RTI application. After the receit of 2nd appeal by SIC authorities , the matter was listed for hearing on May 29, 2014, June 30 and September 30. On June 30, the DSP (Hqs), Jammu, who is also the PIO, apprised the commission that the matter was re-enquired through zonal SPs and report obtained regarding how many cases were registered against Zakir Hussain and Ashiq Hussain. The PIO submitted 6 leaves under office letter No RTI/2013/171/2798-99 dated 28-06-2014. The said letter along with enclosures has been taken on record for reference. During the course of proceedings held at SIC office, Jammu, on 30.9.2014, Shashi Thakur, authorised representative of Dr R P Singh, who is also the appellant, apprised the commission that till date no information has been provided to the information seeker and requested that the PIO be directed to furnish the complete information as sought in the RTI application. SIC order against Jammu Police reads as: "In view of the aforesaid facts and observations, the PIO is hereby directed to furnish the revised information to the information seeker free of cost within 10 days from the date of receipt of this order under an intimation to the commission. The PIO is further directed to send the information under a registered cover at the residential address of the appellant mentioned in the RTI application."
