HC orders status-quo on Asst Commr's transfer 10/30/2014 12:17:34 AM Jammu, Oct 29 : In a petition filed by Suram Chand Sharma who was transferred Vide Govt order No 290- RD&PR of 2014 dated October 21, 2014 has been transferred from Assistant Commissioner Development Jammu to the post of Project Officer (WS) Reasi within a week of his posting as ACD Jammu vide Govt order NO 1058-GAD of 2014 dated October 16, 2014. The petitioner submitted that that his transfer is premature and is violative of transfer Policy duly notified vide Govt. Order No. 861-GAD of 2010 dated 28-07-2010 read with Govt. It has been alleged that his premature transfer is actuated by malafide for the simple reason that Commissioner/Secretary Rural Dept failed to provide the reasons and grounds which necessitates' his premature. Justice Janak Raj Kotwal after hearing Advocates Hunar Gupta and Dewakar Sharma appearing for the petitioner observed that impugned transfer order of the petitioner is premature on face of it makes out a prima-facie case in favour of petitioner and issued notice to the State and Ors and in the meanwhile Court ordered that subject to objections and till next date before the Bench, status-quo as regards present place of petitioner of the petitioner that is ACD Jammu shall be maintained.
