Report on increasing Child Labour treated as PIL

Jammu, Oct 29 : A report on increasing Child Labour in the State of J&K by Advocate Deepika Singh Rajawat which was sent to Chief Justice treated has been treated as a Public Interest Litigation.
In the report it was submitted that Brijesh who belongs to Bahraich Utter Pradesh, in violation of Child Labour Act, 1986 was forcibly engaged into child labour/domestic labour by a Jammu based businessman, Kanwar Chabra. Some people, known to Brijesh's father who is a poor man convinced him to send minor Brijesh with them to enroll him in a good school. Trusting them, father of Brijesh sent him with them who in connivance with Kanwar Chabra, forcibly engaged Brijesh into domestic labour at the residence of Kanwar Chabra. Finally in August this year, after seven months of slavery and hardship, Brijesh was rescued when his father came to meet him to take him home as his ailing mother wanted to meet him. After getting angry with Brijesh's request to go home, Kanwar Chabra for hours together thrashed Brijesh. He was tied in ropes and was mercilessly beaten up to the extent that when he was rescued, he was not able to sit on his buttocks.
After long struggle, concerned Police Station registered FIR against the relatives of Suresh and Kanwar Chabra. Department of Labour which generally feels helpless to rescue children engaged into domestic labour also initiated prosecution against the culprits. One of the culprits was booked and easily bailed out. Police could not nab others. Justice delayed is justice denied. Brijesh is still waiting for justice for law is so complex that poor one has to wait for years together to accused behind bars… He has forgotten to smile.
A Division Bench of State High Court Comprising Justice Dhiraj Singh Thakur and Justice Bansi Lal Bhat after hearing Adv Deepika Singh Rajwat in person issued notice to State and directed the state to file objections on or before December 1, 2014. JNF
