SC directs J&K Govt to place SIT report on record | | | Early Times Report SRINAGAR, Oct 29: The Supreme Court has directed State Government to place within six weeks the report of Special Investigation Team into the killing of teenager Wamiq Farooq in Old City here in 2010. "Learned senior counsel for the petitioners (State of J&K) is directed to place the outcome of the deliberations of the Special Investigation Team on the record of this case within six weeks," apex court's Division Bench comprising Justices Jagdish Singh Khehar and Arun Mishra said while hearing SLP filed by the State Government against High Court order in 2011. The High Court had dismissed the Revision Petition filed by the Government, challenging the trial Court's order directing it to constitute Special Investigation Team to investigate the death of the teenage boy after being hit allegedly by a police tearsmoke canister in 2010. "The orders passed by the trial court in the petition be acted upon promptly without any delay so that the SIT is in a position to dig out the actual facts and place its report before the CJM Srinagar," the High Court had said. Father of the boy, Farooq Ahmad Wani had filed a complaint before the CJM Srinagar on Feb 25, 2010 regarding the lodgment of FIR against the Sub Inspector Ab Khaliq Sofi and Head Constable, Mohammad Akram accused of killing his son. After the compliant was heard by the Court of CJM, it on Feb 5, 2011 directed police to constitute SIT of at least three officers of known professional competence and integrity, headed by an officer of the rank of Superintendent of Police. The SIT was asked to examine the persons who were witness to the incident with respect to points of firing of the tear smoke shells and that of its hitting the victim individually as well as collectively. The SIT was constituted which submitted its report on April 24 last year and it does not rule out the possible cause of Wamiq's death due to tear gas shell, apart from other reason being fall from the Gani Memorial Stadium wall. The CJM while issuing warrants against the ASI and the SPO had observed that there was nothing on record from medical evidence which would completely rule out the possibility of death of the boy due to hitting of tear smoke shell. |
