Jammu, Oct 30 : Principal Sessions Judge Kishtwar Bala Joyti today acquitted two alleged terrorists of HM as the investigation was shoddy and Contaminated Statements of Prosecution Witnesses with major contradictions. According to the police case, on the basis of written complaint lodged by Major S.P Singh,a case was registered at Kishtwar police station on June 30, 2009 for the commission of offences under section 7/25 of Arms Act against the accused. It was complained that two HM terrorists named Javed Ahmed and Ghulam Haider had voluntarily surrendered before Army and Police at 'Pullar bridge', Kishtwar, on May 20, 2009 at 5.30 am along with weapons. It was further reported that above mentioned individuals were involved in terrorist activities in the area since long, hence they were questioned for their involvement in other cases. Moreover the above said individuals were apprehensive of other active militants. Both the surrendered militants along with their above said weapons were handed over to police for further necessary action under law. The judge, after hearing both the sides, observed that the prosecution has miserably failed to prove charge against the accused persons beyond reasonable doubt. They are hereby acquitted of the charge. They were in judicial custody. They shall be set at liberty forthwith if they are not required in any other offence/case, she ordered. (JNF) |
