HC directs SHO Majalta to file status report in gang rape case with Bakerwal Tribe

Jammu, Nov 21: In a petition filed by prosecutrix belonging to Bakerwal Tribe and their families it has been stated that one Mohd. Anwar caught hold of petitioner and gave her a blow with a danda on her arms and 7 Haroon slapped her and they caught hold the petitioners and thereafter both the petitioners were subjected to gang rape by the respondents and this gruesome incident continued till 4 AM and with the appearance of the moon they proceeded towards their houses and narrated the whole incident to their families.
After committing the Crime respondents warned the petitioners that in case they disclosed this incident to any one they will be eliminated and if they suppressed then they will be monetarily compensated.
The petitioners approached Police Station, Majalta with a written complaint and FIR No.55/2014 dated 06-10-2014 under Section 376/342 RPC was registered against the respondents.
On 07-10-2014 the statement of the petitioner No.2 was recorded before the Learned JMIC, Majalta under Section 164-A Cr.P.C and similarly the statement of prosecutrix was recorded on 09-10-2014 before the said Court.
In the said statements the petitioners narrated their tale of woes and substantiated the contents of aforementioned FIR.
More than 40 days have expired from the date of registration of FIR No.55/2014 but there is no headway in the investigation as the accused are roaming freely in the society and are extending open threats to the petitioners and their family members.
The police is investigating the matter casually and has so far not taken serious steps to arrest the accused in such a heinous offence.
The police cannot be allowed to act as a mute spectator as he is under a legal/statutory obligation to investigate the matter fairly uninfluenced by the political patronage enjoyed by respondents. Justice Mohammad Yaqoob Mir of J&K High Court Jammu wing issued notice and directed IO of the case to file latest status report of the case.(JNF)
