HC asks Govt to give timeframe for making PSC functional

Srinagar, Nov 22: The J&K High Court has directed government to indicate timeframe for filling up of various posts in Public Service Commission (PSC) to make it functional again.
Hearing a petition filed by a forest officials seeking promotion to gazetted rank through DPC, a single bench of the court comprising Justice Ali Mohammad Magrey also asked government through Secretary GAD to detail out reasons for not filling up the posts till the date.
The direction by the court followed submissions by advocate Azhar-ul-Ameen (counsel JKPSC) that no Commission exists on the date.
"As per the scheme provided under constitution of (the state), every Gazatted post is to be filed up by the on recommendations of Public Service Commission and clearance from Departmental Promotion Committee. However, at present there is no Commission existing as all its members and Chairman have demitted office on completion of their term," the counsel said.
In the instant case, the court observed that while Commissioner Secretary Forests is on record to state that the case of the petitioner stands forwarded to Public Service Commission for clearance in terms of order passed on 7-8-2014 and had no other formality to be completed. "…However the communication dated 31-10-2014 placed on record speaks volumes about the uncalled for approach adopted by the government for having no intention to implement the court judgment," the court said.
Counsel for PSC also invited attention of the court to the Communication dated 31-10-2014 from Deputy Secretary Forest, Environment and Ecology addressed to Secretary PSC whereby request of the Commission for holding meeting with DPC for considering the case of petitioner along with other two items fixed on 11-11-2014 is not agreed with reference to clearance of observations of DPC by the Head of departments.
Meanwhile, the court asked the Commissioner Secretary Forests to file response and also ensure that the judgment of the court is implemented in letter and spirit before next date of hearing, posted on November 28.
