DB imposes cost on BOPEE | PIL challenging Reservation Rules of 2005 | | Jammu, Nov 25 : In a Public Interest Litigation (PIL) filed by a social activist Ashok Sharma challenging Rule 17 of Reservations Rules framed under Reservation Act of the State, Division Bench of High Court comprising Chief Justice MM Kumar and Justice TashiRabstan after hearing AdvKuldeep Singh Parihar for the PIL whereas Adv Anil Sethi for the BOPEE, observed that Despite various opportunities granted, an affidavit in terms of order dated 27.10.2014 has not been filed. Anil Sethi stated that the affidavit is ready and the same shall be filedtomorrow in the registry. Division Bench further observed that on the last date of hearing, excuse was put forward that on account of floods, supplementary affidavit could not be filed. However, similar excuse has been put forward today and directed that affidavit be filed tomorrow. However, the same shall be subject to payment of Rs.2500/- as costs. According to the counsel for the PIL once a candidate belonging to reserved category is selected against open merit seat than he is to be considered for allotment of discipline/stream/college allocable to him on the basis of his merit and preference. The Rule further provides that the resultant discipline/stream/college in the open merit category shall be allotted to reserved category candidate who is selected upon the reserved category candidate getting selected in the open merit category.
