DB directs DC Poonch to file status report or appear in person

Jammu, Nov 26 : In a Public Interest Litigation seeking compensation for LoC mine blast victims, A Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Tashi Rabstan after hearing the PIL whereas AAG Ravinder Sharma for the state whereas ASGI Sindhu Sharma appearing for the Union of India, took serious note on the part of Deputy Commissioner Poonch for filling status report and directed him to file status report within two weeks failing which Deputy Commissioner Poonch shall remain present in person.
When today PIL was taken-up, the Division Bench of State High Court observed that the this PIL pertains to payment of compensation to such person who have suffered mine blasts in the area of Poonch and its adjoining area and in which Union of India has stated that the total numbers of cases reported since December 10, 2001 were 90 and the compensation has been paid to 44 victims and in respect of remain 46 cases, 28 cases have been returned to Deputy Commissioner Poonch for obtaining details of the cases and tow cases have been forwarded to the higher authorities for processing the documents and in respect of 16 cases no information is available with the Army and the efforts are in progress to identify such cases by taking up the issue with the civil authorities.
It has also been submitted that the cases sent by Civil Authorities were in complete and the cases in all respect of criteria prescribed for payment of compensation and concerned Deputy Commissioners were requested to complete the cases in all respect as per the requirement of the scheme and then send the complete information, so that the cases may be processed for payment of compensation.
Upon this Division Bench observed that despite time given Deputy Commissioner Poonch has not filed the latest status report as per direction issued and however a document has been placed on record showing that the DC Poonch has sent nine cases for payment of ex-gratia compensation to the victims.
Division Bench directed Union of India to file the status report regarding the names of nine persons which were sent by the Deputy Commissioner Poonch and took serious not that the reason for not filling the latest status report by DC Poonch by stated that the election process which is in progress in District Poonch, on this Division said that the such an excuse is not acceptable because in important matter like on in hand and DC Poonch cannot neglect the filling of the status report and directed DC Poonch to file status report within two weeks or appear in person.
