Adhere to orders on conversion of Agri land or face contempt: HC directs DCs | | | Early Times Report
Srinagar, Dec 17 : The J&K High Court has directed Deputy Commissioners of Kashmir to abide by its directions on conversion of agriculture land. In case of failure to do so, a Division Bench of the court comprising Justice M H Attar and Justice B L Bhat said that contempt proceedings will be initiated against them. The court had last month directed the Deputy Commissioners to comply with statutory provisions and its directions banning the conversion of the land for any other purpose such as construction of houses etc. "As already directed, all the Deputy Commissioners of the Kashmir to explain as to why the Court order dated 25th November, 2014 has not been complied with. They shall also inform as to why they may not be proceeded against," the court said and directed all the Deputy Commissioners of Kashmir to comply with order. "All the Deputy Commissioners of Kashmir shall comply with order dated 25th November, 2014, failing which contempt proceedings will be initiated against them. The Divisional Commissioner, Kashmir to inform the Deputy Commissioners about the order of the Court," the Division Bench said. In another direction, the Division Bench also directed the Divisional Commissioner, Kashmir, to ensure implementation of statutory provisions regarding removal of encroachments from Kahcharai land. The court said that he was further directed to ensure compliance of the directions of the Supreme Court and that he will be personally responsible to seek implementation of the statutory provisions and Court directions. "Despite directions, the Divisional Commissioner, Kashmir, has not complied with the order as no Compliance Report has been filed. At this stage, instead of proceeding against the Divisional Commissioner, we give him one final opportunity to comply with the orders," the bench said. Meanwhile, Commissioner Secretary, Housing & Urban Development Department, filed affidavit stating that Master Plan for Srinagar City is being revised and prepared for the year 2012-32.It is also stated that the State Cabinet has already approved extension of area from 416 to 757 Sq.KM in the revised Master Plan. This proposed Master Plan is being published for inviting suggestions/objections, the affidavit said. It is stated that the Srinagar Development Authority (SDA) has conceived the idea of setting up of "Satellite Township" at Rakh-i-Gund Aksha, Srinagar. "The Commissioner Secretary, Housing & Urban Development Department, as also Vice Chairperson, SDA, are directed to vigorously pursue the proposed draft Master Plan as also plan for construction of Satellite Township," the court said and directed them to inform the court as to what further steps have been taken for accomplishing the purposes. |
