| Sex racket case: HC quashes DM's order regarding sealing of 'Pink House' | | | Jammu, Jan 24: In a petition filed by Shaheeda Parveen who was allegedly involved in running the brothel at Pink House Roop Nagar challenging the order of District Magistrate Jammu whereby the DM Jammu has sealed his house namely Pink House situated at Upper Roop Nagar Jammu after the registration of case u/ss 376/109/342/506 RPc and 4/5 Immoral Trafficking Prevention Act 1956 at Police Station Janipur Jammu. Justice Hasnain Massodi after hearing VR Wazir for the petitioner whereas AAG HA Siddiqui appearing for the state observed that there is a substance in the stand in the stake taken by the petitioner against the impugned order and a mere look on the order would revealed that petitioner was in custody on the date, the show cause notice was served through Jail Authority and against the above backdrop, the petitioner is not in a position to organize her defence and project her stand before the DM Jammu.
With these observations Court allowed the petition and quashed the order of the District Magistrate Jammu with a direction to DM Jammu shall issue fresh notice in terms of section 18 to the petitioner and in the event, notice is issued, the proceedings be concluded within two weeks from the date of notice and in the meantime, premises will continue to remain sealed.
Justice Hasnain Massodi further observed that in case proceedings are not concluded within two weeks or fresh notice is not issued, the premises shall be restored to handed over to the petitioner and the petitioner be informed about the decision taken, enabling her to work out for her remedy, if any, available under law.
