While Omar failed, Guv wasted no time in invoking Section 4 of RTI Act in J&K

JAMMU, Jan 31: The J&K Right to Information Act (RTI) will complete its six years of its enactment in the state after one month. As this progressive and pro-people legislation is enforced in state from last almost six years, the previous state government led by Omar Abdullah continued to take this law for granted and thus avoided the responsibilities which had been conferred upon them under the provisions of this Act.
The orders issued by the Government on the directions of Governor N N Vohra vis-à-vis making voluntary/suo-moto disclosure under Section 4 of JK RTI Act 2009 for effective implementation of Right to Information Act (RTI) and asking the government to ensure submission of annual property returns by government officers by Jan 31 has not only boosted the morale of whistle-blowers or RTI activists but this intervention is being seen positively by all sections of the society.
These positive developments would definitely empower the State Vigilance Commission (SVC), Vigilance Organization (VO) and State Information Commission (SIC) as well.
The previous state government was under legal obligation to implement J&K RTI Act 2009 and it was government and not the State Information Commission (SIC) which had to create awareness and ensuring suo-moto/proactive disclosures under this Act. But unfortunately the Chief Information Commissioner (CIC) G R Sufi was compelled take training classes on RTI for Public Information Officers (PIO's) and First Appellate Authorities (FAA's) designated under the J&K RTI Act.
Omar led government didn't bother to even publish RTI related material/booklets etc which could have helped the public to know the provisions of this law. The basic awareness programmes on RTI too were not conducted by the government in six long years.
The government had failed to implement Section 4 (1) (b) of J&K RTI Act 2009 and thus proactive disclosure of all government orders, circulars, selection lists, merit lists, payment of compensation, relief, subsidy, seniority lists and beneficiary lists under various state and centrally sponsored schemes and other related information was not made available on the official government websites.
"The government had to undertake voluntary disclosure under section 4 (1) (b) of State RTI Act within four months from the day of enactment of J&K RTI Act 2009, but almost six years elapsed and nothing could be done and the Governor made this happen within six days by grilling the state administration. We are grateful to Shri Vohra the Governor of J&K for his recent orders directing the Government officers to submit their annual property returns by Jan 31, the previous government was least bothered about all these issues and that is the reason corruption flourished during last six years in J&K," said Dr. Mushtaq Khan, a Srinagar based anti corruption crusader and a noted RTI Activist.
