Supari killing case: Court denies bail to Sunny Choudhary

Jammu , Feb 28 : 1st Additional Sessions Judge Jammu today rejected the bail application of Sumit alias Sunny Choudhary alias Sunny Baba who was facing trial in murder case seeking bail on medical grounds. It is worthwhile to mention here that Sumit alias Sunny Choudhary alias Sunny Baba was also facing trial in much publicized Supari Killing case. While the petition was taken up here today, 1st Additional Sessions Judge Jammu Mohan Singh Parihar after hearing Sr Advocate Sunil Sethi with Adv Ashwani Khajuria appearing for the accused whereas APP for the state observed that as per photocopy of the medical record produced by the Superintendent Central Jail Kote Bhalwal, Jammu the accused was admitted in GMC Jammu on 07/02/2015 and discharged on 18/02/2015. "He (petitioner) remained stable during the period of his treatment in the hospital and as per clinical test there was no bleeding per rectum, court said while refereeing to medical records and said there is no medical report of any doctor on the record to the effect that the ailment suffered by the accused involves any risk. Court after considering the prayer of the accused-applicant for bail on the medical ground and in the light of the given facts and circumstances of the case and in my opinion keeping in view the involvement of the accused in the offences u/s 302, 120-B, 109 RPC, the accused is not entitled to bail and thus his application for bail is dismissed. However, the court directed the jail authorities to take the accused under police escort to PGI Chandigarh/AIIMS Delhi as advised by the doctors of GMC Jammu, for special tests i.e. Endoscopy and Colonoscopy and for other necessary medical treatment. Meanwhile a copy of court order was also sent to Superintendent, Central Jail Kote Bhalwal, Jammu and SSP Jammu for due compliance.
According to the application, for the last few months, the applicant is suffering from a serious ailment of passing of blood in the stool and in this regard the applicant has been taken to GMC Jammu for medical treatment by the concerned authorities but, he has not been properly treated and still the applicant is suffering from the said ailment and due to loss of blood the applicant has become weak and the concerned doctors of GMC Jammu are unable to diagnose the cause of said ailment. It has been further stated that the doctors of GMC have advised the applicant to undergo some specialized tests for diagnosis of the disease and the facility of the said tests is not available in GMC, Jammu and for that purpose the applicant is required to be taken to some specialized hospitals outside the State of J&K i.e. PGI Chandigarh or AIIMS Delhi and for that purpose the applicant is ready to furnish sufficient security for grant of bail and he will abide by the terms and conditions imposed by the court while enlarging him on bail.
