| While in power Congress failed to pass Land Acquisition Act in J&K | | Has no moral authority to protest against it | |

Jammu, Feb 28: A few days back, the district unit of Congress party staged a demonstration against BJP-led National Democratic Alliance (NDA) at Kathua , terming the recent ordinance and subsequent amendments in the Land Acquisition Bill as anti- farmer but one fails to understand against whom the party is protesting as it could not bring the Bill in state assembly while it was in power. The new Land Acquisition Rehabilitation & Resettlement Act (LARR) which was enacted by Congress led UPA Government has been enforced across all the states from January 1, 2014 except J&K. The law could not be extended to J&K in view of article 370 and the Omar-led government failed to enact a similar law in the state. The new Land Acquisition Act was made operational through a Presidential assent . The J&K Government failed to bring this bill in the budget session of state legislature. The bill was not even tabled in the State Legislature during the last session of assembly when the Government had the last chance to enact this law which is going to benefit a large amount of population living both in rural as well as urban areas of the state. The New Land Acquisition Rehabilitation and Resettlement Act (LARR) law has a great importance especially in Jammu & Kashmir as thousands of acres of land has been acquired by Government at many places in the state. Congress which was part of the coalition government in state had also been mum over the issue inspite of the fact that the same party at the Centre enacted this law. It is pertinent to mention here that PDP had brought a Private Members Bill on this issue in the state legislature during last session of state legislature. PDP spokesman and MLC Naeem Akhtar had pushed this bill which according to sources was send for correction by the council secretariat. Under the new Land Acquisition Act property and land which is acquired in urban areas would be paid compensation double the market value of the said land / property etc and in rural areas where the property rates are comparatively less the compensation would be paid four times more than the extact market rate of the land / property . There are several areas in Jammu as well as in Srinagar's old city where many residential houses / shops have been dismantled recently for a road widening project. If a family in Srinagar city was paid Rs 10 lakhs as compensation for the dismantled house or shop during road widening , under the new Land Acquisition Act, it would have got Rs 20 lakhs plus job and a land to construct a house as well . The new Land Acquisition law does not only guarantee high monetary compensation but it guarantees for Rehabilitation & Resettlement as well. The compensation under new Land Acquisition Act is to be paid retrospectively under this act (from 2011). But all is not going to be a reality in J&K which does not have such a law in operation. The protesters on Thursday were seeking modification in Land Acquisition Bill and flaying NDA on rebuffing Land Acquisition Bill proposed by UPA government. The protest was led by Subash Gupta, ex-MLC. They were raising slogans against Prime Minister Narendra Modi and BJP government. "One fails to understand why the state Congress is protesting against the passage of ordinance on Land Acquisition Act by NDA Government. The act is not at all applicable to J&K , and while Congress remained in J&K, they did not bring the similar bill in state legislature? said Shahnawaz Mir state Incharge Peoples Democratic Students Union , which is the PDP's student wing. |
