Kahcharai land case: DB directs verification of compliance reports from DCs

Srinagar, Mar 28: A Division Bench of the State High Court has directed verification of compliance reports filed by Deputy Commissioners about removal of encroachment from Kahcharai Land. Court also granted three weeks time to government take decision in respect of finalization of proposed Master Plan as also construction of satellite Township
During the hearing in Public Interest Litigation filed by Human Watch International (Regd) V/s State & others, before a Division Bench of the court comprising Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey it was submitted at that the reports filed by Deputy Commissioners would require to be verified by independent persons.
Counsel for the petitioner submitted that G A Peer (Retd) Commissioner Secretary would be the best person who can be entrusted with the job of getting these reports verified and make recommendations for protection and preservation of the Kahcharai land.
"Mr Peer, if agrees would be associated by two persons who would be the members of the committee," the Division Bench said and asked Registrar judicial to seek consent from G A Peer as also from Ghulam Qadir Wani, Retd District and Sessions Judge.
In their reports the deputy commissioners have mainly stated that they are keeping strict vigil on state land and no violation is being allowed.
In another direction, the court granted three weeks time to government take decision in respect of finalization of proposed Master Plan as also construction of satellite Township.
Pertinently in December last, Commissioner Secretary, Housing & Urban Development Department, has filed affidavit stating that Master Plan for Srinagar City is being revised and prepared for the year 2012-13.
It was also stated that the State Cabinet has already approved extension of area from 416 to 757 Sq.KM in the revised Master Plan, besides the Srinagar Development Authority (SDA) has conceived the idea of setting up of "Satellite Township" at Rakh-i-Gund Aksha, Srinagar. Subsequently the court had directed Commissioner Secretary, Housing & Urban Development Department, as also Vice Chairperson, SDA, to vigorously pursue the proposed draft Master Plan as also plan for construction of Satellite Township.
