Prosecution failure leads to acquittal in murder case

Jammu, Mar 28: Principal Sessions Judge Jammu R S Jain today acquitted one Mohd Shafi who was facing trial in murder case of one Kuldeep Singh as prosecution has failed to prove the charge against the accused for the offence under Sections 302 RPC. Principal Sessions Judge Jammu R S Jain after hearing Adv Rajesh Thappa appearing for the accused, held that the prosecution has failed to bring home the charge against the accused person for the offence under Sections 302 RPC. And the accused Mohd Shafi hereby is acquitted of the charge under Sections 302 RPC/4/25 Arms Act. The accused who presently is under judicial custody be released if not required in any other case, the court said According to the police case that on 3/7/2011, information was received from reliable source by Police Station Akhnoor that Kuldeep Singh has been murdered by someone due to previous enmity with a sharp edged object by hitting him repeatedly on the head and the dead body is lying at Majen Morh Nalluh, Akhnoor in the bushes.
An case against FIR No.147/2011 for offence u/s 302 RPC/4/25 Arms Act was registered in Police Station Akhnoor and investigations were taken up. During the investigation, the I/O arrested Saleema Bibi d/o accused Mohd Shafi and on disclosure of Saleema Bibi, one mobile phone was recovered.
Thereafter accused Mohd Shafi arrested and the weapon of offence and one burnt SIM was recovered on identification of accused Mohd Shafi from his house. It came out that deceased Kuldeep Singh was murdered by Mohd Shafi and Saleema Bibi. The investigations also revealed Kuldeep Singh used to visit their house with an intention to develop illicit relations with Saleema Bibi and deceased was threatening Saleema Bibi to develop relation with her otherwise he will destroy her reputation and after completion of investigation challan was presented and vide order dated 1/2/2012, accused Saleema Bibi was held to be a juvenile while accused Mohd Shafi was charged for offence u/s 302/201/34 RPC/4/25 Arms Act accordingly.
