Flood fury: No fee for Sept, Oct, HC tells all pvt schools in Valley

Srinagar, Apr 20: The J&K High Court directed all private schools in Kashmir Valley on Monday not to charge fee for September and October last year due to the devastating floods.
As soon as hearing in a public interest litigation started before a division bench of Justices Muzaffar Hussain Attar and Ali Mohammad Magrey, a number of lawyers including amicus curie G A Lone alleged that many educational institutions had charged tuition and bus fee for the months of September and October despite repeated orders from the court.
Also, some schools have increased fee, they said.
On this, the division bench directed all private educational institutions to give an undertaking within two weeks before the Registrar Judicial they have not charged tuition and bus fee for the months of September-October 2014.
The undertaking, according to court, should also read, "We certify that the fee charged for these two months has already been adjusted for the months of November-December 2014 onwards. We further certify that we have not increased tuition fee as directed by the court on December 30, 2014 and have not charged enhanced fee on the students."
The court however said the educational institutions would be at liberty to seek vacation/modification of orders passed by it from time to time, and in order to justify their claims, they shall give detailed information supported with evidence/material.
The interim directions passed from time to time in the PIL shall continue till further orders from the court, the bench said.
The cases of individual institutions, it said, will be considered and scrutinized on their own merit and orders accordingly passed.
"It is made clear that the directions restraining the private educational institutions from taking tuition and bus fee for the months of September-October 2014 is applicable to all the private educational institutions. Direction for not increasing the tuition fee is also applicable to these private institutions and they shall comply with the same," the court said.
On March 9, the court had taken cognizance of the submissions made at bar in respect of the allegations that children and parents are being fleeced in the name of purchase of books, stationery and issuance of identity cards.
Lone, the amicus curie had requested for constitution of a committee of experts that would make recommendations for ending the practice.
"All the learned counsels are requested to give names of persons for constitution of committee of experts. Names be provided to Registrar Judicial within week's time," the court said.
Lone at this stage suggested name of Dr. Farooq Ahmad who was working earlier as Registrar Kashmir University and presently Controller J&K BOPEE. He informed that he was willing to be member of the expert committee.
"Earnest efforts are being made by the court for the benefit of school going children who are the future of the nation. The efforts are to be made by everybody to ensure that future of the nation is not jeopardized," the court said.
Meanwhile, the court directed Chief Secretary to file report as to how many libraries are functional in the state.
