Fresh SC hearing inspires hope of Justice in Haji Yousuf’s Family

The fresh Supreme Court hearing in infamous Haji yousuf yousuf Case has raised fresh hopes among the family members of Haji who are desperately waiting to file first information report (FIR) against
the former Chief Minister of Jammu and Kashmir, two other top brass leaders of National conference (NC) and one Police Official. After a division Bench of the Supreme Court comprising J.J Jagdish
Singh Kehar and Justice S.A. Bobde allowed Talib
Hussain son of Haji Yousuf to be a co-petitioner in the petition which was filed by MLA, Shri Balwant Singh Mankotia seeking investigation by CBI.
The SC after hearing Prof Bhim Singh, senior Advocate andSolicitor-General, Ranjit Kumar, family members of Haji yousuf said that it has generated a ray of hope among them to bring alleged culprits to the book of law.
Talking to early times Talib Hussain, whom the supreme Court allowed as a petitioner to plead the case of his father
said that ‘he has filed a petition to be impleaded as co-petitioner before the Supreme Court, seeking to file FIR under Section 302 for alleged murder of his father in the police custody and the case has
been pending before the Supreme Court till October, 2011 and the same impleadment application was filed by Talib Hussain in December last year.
“It is now fourth year and we are waiting for the Justice to be delivered in our favour. I was eager to become Party of the case as a petitioner, thankfully the Supreme Court hearing allowed it. I have all the required proof to expose killers of my father and our first priority is to seek directions from the court to file FIR against Omar Abdullah, Nasir Aslam Wani, Davinder Singh Rana and shabir Ahamd and then an independent probe either by CBI or
by Jammu and Kashmir Police,”added Talib Hussain Pertinently according to details during hearing in the Supreme
Court Ranjit Kumar appearing for the Jammu and Kashmir Government has opposed the petition of Talib Hussain to be impleaded as petitioner and Professor Bhim Singh informed the court that the rules laid down in D.K. Basu’s
case were violated which was the findings of Justice Bedi’s report. He also and submitted that as long as FIR is not filed and investigation is not handed over to some independent agency like CBI, justice cannot
be done. According to details after hearing lawyers, Supreme Court later in its judgement said that Son (Talib Hussain) should be allowed as petitioner in the said case. Pertinently Haji Yousuf who died in a police custody in Srinagar on 29th September, 20 11according to family members was taken to police custody by the orders of the then Chief Minister of Jammu and Kashmir, Omar Abdullah from his official residence after allegedly beating him
ruthlessly in presence of two other top Brass leaders of NC and a police official.
