RTI applicant gets threat calls, SIC takes strong note
Alleged appointment of Doctor on fake degree

Jammu April 26th

An RTI applicant who sought copies of degree certificates of a doctor working in health department is getting threat calls as the applicant alleges that the degree certificates of the said doctor were fake. The copies of the medical degree certificates of the doctor were not provided to the RTI applicant and the case landed in State Information Commission (SIC). The SIC has issued a written direction to Health Department to disclose the details about the official of the health department posted in Rajouri who has made the threatening calls to the RTI applicant.

Details available with Early Times reveal that an RTI applicant namely Deepak Sharma a resident of Kana Chak Jammu filed an RTI application on 20.2.2014 before PIO Health & Medical Education Department, Civil Secretariat, Jammu seeking Certified copy of the service book of Dr. Pushpa Devi Raina; Details of all postings of Dr. Pushpa Devi Raina with respect to term of service in the posted area; Details of promotions granted to Dr. Pushpa Devi Raina for the period from January 2009 to February 2014; Certified copy of the minutes of DPC(if any) conducted for recommending promotion to Dr. Pushpa Devi Raina; Registration number of Dr. Pushpa Devi Raina registered at Medical Council of India and State Medical Council. Also provide the certified copies of certificate of registrations.


SIC in its order stated that the nature of RTI application which is under consideration of the Commission does suggest that it had raised a very important issue of security and safety of a human life. The information seeker states that after making this RTI application he allegedly received in the evening of 7.4.2014 a life threat from somebody who identified himself as an employee of Health Department, Rajouri and threatened the complainant to withdraw the RTI application or “else face the grave consequences”.
The Commission is duty bound to ensure the implementation of the J&K State RTI Act in the state and if during the implementation of said act there are certain impediments or obstructions, the preamble of the Act lays down for the Commission to ensure that transparency and accountability is maintained in the working of every public authority. Secondly, section 16 also empowers the Commission to take several steps to ensure the implementation of its orders. If the RTI users will be silenced through the use of verbal threats or actual force, it is a direct attempt to defeat the very purpose of the RTI Act. Hence, the Commission would like the concerned authorities in the Health Department to make necessary investigation after the further details are given by the complainant and identify the alleged official who is alleged to have threatened the complainant”
