5 Years imprisonment to alleged LeT activist

Jammu, May : Principal Sessions Judge Jammu RS Jain today awarded five years imprisonment to Rashpal Singh alleged activist of Lashkar and acquitted Mohd Sharief as prosecution could not provide enough evidence against him. According to the police case , on 8.4.2008 at 17.45 hrs information from reliable source was received by Police Station Ramban that Rachpal Singh,a shopkeeper in Ramban has connection with militant organization LET and is sympathizers of LET and transports the illicit arms and ammunition of LET from one place to another and also helps the said organization and that accused is in possession of explosive matter. On receipt of this report FIRno.31/08 for offence under sections 7/25 ArmsAct, 4/5 ESA was registered against the accused. Accused Rachpal Singh was arrested and during interrogation, accused Rachpal Singh in police custody in presence of witnesses made a disclosure statement that he has grenade which he has hidden and can get the same recovered after identification. His disclosure statement was prepared and thereafter accused got recovered the Chinese made grenade from the shelf of the room where he was residing and said grenade was seized vide seizure memo. During further interrogation of accused Rachpal Singh he admitted that the grenade was given to him by accused Mohd Sharief alias Farid. Thereupon Mohd Sharief was arrested on 15.4.2008. Offence under section 3 EAO was added to the FIR. On conclusion of investigation the IO finding the accused guilty presented the present challan for offence under section 4/5 ESA, 3 EAO and 7/25 Arms Act. Principal Sessions Judge Jammu Mr. RS Jain after hearing both the sides observed that the facts and circumstance of the case and the evidence led by the prosecution it stands proved that accused Rashpal Singh was in possession of a grenade (prohibited ammunition as defined in Section 2(h) Arms Act) which was seized from the possession by the police on 8.4.2008. Accordingly, the accused is convicted for offence 7/25 Arms Act and sentenced to undergo imprisonment for a period of five years. (JNF)
