| Court seizes Account Head of Director CA&PD Jammu | | | Early Times Report
Jammu, May-27: Expressing displeasure over the non-execution of the Court orders, Chief Judicial Magistrate (CGM) Ramban M R Chak today seized the account head of Director CAPD Jammu for not implementing the Court directions.
CJM Ramban M R Chak observed that the conduct of officers of CA&PD had always been indifferent and it was upon the repeated directions of this court that service book of the an expired employee was got completed and transmitted to Director CA&PD Jammu who in-turn had to submit the same to Accountant General for completion of documents .
Court also observed that as already stated in the earlier orders, the decree holder is on her last legs and in case the matter gets further delayed, in that event, she shall not be in a position to get the usufructs of the judgment and decree. It was recalled that Director CAPD Jammu and the Accountant General were directed to expedite the case of the decree-holder to enable her to get the pensionary and other allied benefits in respect of the death of her late husband earlier on 31/12/2014 and the order has been duly served upon Director CAPD Jammu on 22/01/2015 under the seal and signature of the said clerk whereas same order was got served upon Accountant General on 15/04/2015 through S.O Tamilat, Dist Court Jammu.
Court observed despite a clear direction given to them to conclude the whole exercise within a period of one month from the date of receipt of this order neither the judgment nor decree complied with nor any explanation tendered to this court as of now.
Keeping in view the callous attitude of the judgment debtors, this court is constrained to resort to coercive mode of seeking execution of the judgment and decree by seizure of the head account of the Director CAPD Jammu (and it is accordingly ordered that the head account of the office of Director CAPD Jammu be seized till further orders and copy of this order be forwarded to Dist. Treasury Officer, Jammu for compliance.
This significant direction has been passed in a suit filed by one Ghulam Fatima W/O Late Sh. Abdul Gani R/O Pernote Tehsil and District, Ramban who has been waiting ever since the passing of judgment and decree dated 24.08.2013 to seek service benefits in respect of her late husband. (JNF) |
